Welcome to MOKSH CIRCLE, a brand operated by NewEdge Brands Private Limited
(“MOKSH CIRCLE”, “we”, “us”, “our”). These Terms & Conditions govern your use of
mokshcircle.com, customer accounts, products and services.
By accessing our Website, creating an account or placing an order, you agree to these
Terms along with our Privacy Policy, Shipping Policy, Return/Refund/Exchange Policy
and other policies published on the Website.
1. ELIGIBILITY
You must generally be 18 years or older to independently create an account or place an
order. Persons below 18 should use the Website or make purchases only with the
involvement and consent of a parent or lawful guardian.
2. CUSTOMER ACCOUNT
Customers are responsible for providing accurate information and keeping their
password, OTP and login details secure. Please notify us if you suspect unauthorised
account activity.
We may restrict or suspend accounts for: Fraud, Fake orders, COD abuse, False
information, Security risks, Illegal activity, Misuse of offers, Violation of these Terms.
3. ACCEPTABLE USE
You may use the Website only for lawful personal shopping purposes.
You must not use the Website for: Fake or fraudulent orders, Impersonation, Hacking,
Malware, Scraping, Automated bots, Phishing, Spam, Unauthorised data extraction,
Intellectual-property infringement, Promotion manipulation, Security bypassing,
Unauthorised commercial AI/model training or any illegal activity.
4. INTELLECTUAL PROPERTY
All MOKSH CIRCLE intellectual property belongs to, is licensed to or is lawfully used by
NewEdge Brands Private Limited.
Protected material includes: MOKSH CIRCLE name, Logo, Trademarks, Product
photographs, Videos, Product designs, Artwork, Packaging, Website design, Graphics,
Product descriptions, Advertisements, Social-media creatives and Marketing content.
You may not copy, reproduce, distribute, modify, scrape, resell or commercially use our
content without prior written permission.
5. PRODUCTS & NATURAL VARIATIONS
MOKSH CIRCLE may sell spiritual, devotional, jewellery and lifestyle products including
Rudraksha, Malas, Karungali products, Crystals, Gemstones, Stones, Beads, Bracelets,
Lockets, Chains and related products.
Natural products may vary in: Colour, Shade, Shape, Size, Weight, Texture, Grain,
Surface markings, Bead formation and Minor dimensions.
Such reasonable natural variations are part of the nature of the product and are not
automatically considered defects.
6. PRODUCT IMAGES
We make reasonable efforts to display products accurately. However, actual products
may vary slightly due to: Lighting, Photography, Screen settings, Device displays,
Manufacturing batches and Natural-material variations.
Significant errors or incorrect products remain subject to our Return/Refund/Exchange
Policy.
7. SPIRITUAL & TRADITIONAL INFORMATION
Our products may be associated with Hindu, Sanatani, devotional, spiritual, cultural,
traditional or astrological beliefs.
Any spiritual benefits described on our Website are provided for cultural, traditional,
spiritual and informational purposes.
MOKSH CIRCLE does not guarantee specific results including: Wealth, Financial
success, Luck, Protection, Healing, Marriage, Relationships, Employment, Business
success, Removal of negative influences, Change of destiny or any specific spiritual or
astrological outcome.
Individual beliefs and experiences may vary.
8. NO PROFESSIONAL OR MEDICAL ADVICE
Information regarding Rudraksha, crystals, gemstones, spiritual practices, wellbeing or
traditional beliefs is not intended as Medical advice, Diagnosis, Treatment, Financial
advice, Legal advice or other professional advice.
Our products should not replace professional medical care, medication or advice from
qualified professionals.
9. CERTIFICATES & AUTHENTICITY
A certificate, laboratory report, authenticity card or similar document will be provided
only where the relevant product page specifically states that it is included.
Third-party certificates are subject to the testing methods and representations of the
issuing organisation.
10. JEWELLERY & PRODUCT CARE
Plating, chains, metal parts, caps, clasps and decorative finishes may naturally fade,
oxidise or change over time.
Factors affecting product appearance include: Water, Sweat, Perfume, Cosmetics,
Chemicals, Soap, Sanitiser, Humidity, Friction and Daily wear.
Normal wear and tear is not automatically considered a manufacturing defect.
11. PRICING
Prices are displayed in Indian Rupees (₹) unless otherwise stated.
Prices, offers and discounts may change from time to time. A customer is generally not
entitled to a retrospective refund or price adjustment simply because the product
becomes cheaper after an accepted order.
Applicable Shipping charges, COD charges, Taxes or other fees will be displayed or
communicated where applicable.
12. PRICING OR LISTING ERRORS
Website information may occasionally contain errors relating to: Product prices,
Discounts, Descriptions, Availability, Shipping charges, Promotions, Product
specifications.
We may correct such errors and, where reasonably necessary, cancel the affected
order.
If we cancel an eligible prepaid order because of an error, the collected amount will be
processed according to our applicable refund policy and law.
13. PROMOTIONS, COUPONS & FREE GIFTS
Offers may include: Coupons, Discount codes, Free shipping, Free gifts, Bundles,
Festival offers, Prepaid discounts and Limited-time promotions.
Offers may have separate conditions regarding: Validity, Minimum purchase, Eligible
products, Maximum discount, Payment method, Usage limit and Customer eligibility.
Unless specifically stated, multiple offers cannot be combined. Promotional terms may
be changed or discontinued prospectively.
14. ORDER ACCEPTANCE
Displaying a product on the Website does not guarantee final acceptance of every
order.
Orders are subject to: Product availability, Successful payment, COD eligibility,
Customer verification, Accurate information, Delivery serviceability, Fraud checks and
Applicable policies.
An automated order confirmation may only acknowledge receipt and may still be
subject to necessary verification.
15. ORDER CANCELLATION OR RESTRICTION
MOKSH CIRCLE may hold, limit, reject or cancel an order for reasons including: Product
unavailability, Inventory error, Quality-control failure, Payment failure, Pricing error,
Suspected fraud, COD verification failure, Incorrect information, Delivery issues,
Promotional misuse, Repeated COD refusal, Repeated RTO, Security concerns,
Unauthorised resale or Legal requirements.
Where we cancel an eligible prepaid order, the applicable collected amount will be
processed according to our refund policy.
16. QUANTITY LIMITS & RESALE
We may limit quantities based on: Customer, Account, Mobile number, Address,
Payment method, Household, Promotion or Order.
Products purchased through the consumer Website are primarily intended for personal
use or gifting.
Commercial resale, wholesale purchase, dealership or systematic redistribution requires
prior permission from MOKSH CIRCLE.
17. PAYMENTS & COD
Available payment methods may include: UPI, Credit cards, Debit cards, Net banking,
Digital payments, Cash on Delivery and other payment options introduced from time to
time.
COD may depend on: PIN code, Order value, Product, Customer verification, Previous
order history and Operational requirements.
We may verify COD orders through: Phone, SMS, WhatsApp, OTP or other reasonable
methods.
For high-value, high-quantity, bulk or higher-risk COD orders, MOKSH CIRCLE may
require up to 50% advance payment, with the remaining eligible amount payable
through COD.
Repeated fake orders, COD refusals or RTO misuse may result in COD being restricted
and future orders being required to be prepaid or partially prepaid.
18. SHIPPING & DELIVERY
Shipping, dispatch, delivery estimates, tracking, RTO, address changes and shipment
disputes are governed by our separate Shipping Policy.
MOKSH CIRCLE currently ships within India only.
Delivery timelines are estimates unless expressly stated otherwise.
19. RETURNS, REFUNDS, EXCHANGES &
CANCELLATIONS
Returns, Exchanges, Replacements, Refunds and Cancellations are governed by the
separate policies available in the Policy section of mokshcircle.com.
Eligibility may depend on: Product category, Order status, Reason, Product condition,
Reporting period, Supporting evidence and Applicable offer conditions.
Nothing in these Terms removes any consumer right that cannot legally be restricted.
20. REVIEWS & USER CONTENT
Customers may voluntarily submit Reviews, Ratings, Testimonials, Photos, Videos,
Comments and Feedback.
By submitting such content, you confirm that you have permission to provide it and,
subject to applicable law, allow MOKSH CIRCLE to use it for: Website pages, Social
media, Advertisements, Marketing campaigns and Brand communications.
We may make reasonable formatting or grammatical edits without intentionally
changing the meaning.
Customers must not submit unlawful, defamatory, misleading, infringing or malicious
content.
21. COMMUNICATIONS
We may send transactional communications relating to: Orders, Payments, COD
verification, Shipping, Delivery, Returns, Refunds, Customer support and Account
security.
Subject to applicable law and customer preferences, promotional communications may
be sent through: Email, SMS, WhatsApp, Telephone, Push notifications and other
available channels.
Customers may opt out of eligible promotional communications using available
unsubscribe or opt-out methods.
22. THIRD-PARTY SERVICES
MOKSH CIRCLE may use third-party providers for: Payments, Shipping, Logistics,
Website technology, Hosting, Analytics, Customer support, Communications,
Advertising, Security and other operational services.
Independent third-party services may have their own terms and privacy policies.
23. PRIVACY
Collection, use, processing and protection of personal information are governed by our
separate Privacy Policy available on mokshcircle.com.
24. WEBSITE AVAILABILITY
We aim to keep the Website secure, accurate and operational, but uninterrupted access
cannot be guaranteed.
Temporary interruptions may occur because of: Maintenance, Technical errors,
Software updates, Server failures, Internet issues, Security incidents, Third-party
outages or Events outside our control.
25. FORCE MAJEURE
MOKSH CIRCLE will not be responsible for delays or failures caused by circumstances
outside our reasonable control, to the extent permitted by law.
Such circumstances include: Floods, Heavy rainfall, Cyclones, Storms, Earthquakes,
Fires, Natural disasters, Epidemics, Pandemics, War, Civil disturbance, Strikes,
Lockouts, Courier disruption, Transport disruption, Government restrictions, Curfews,
Power failures, Internet failures, Telecommunications failures and Supply-chain
disruptions.
26. LIMITATION OF LIABILITY
Nothing in these Terms excludes consumer rights or liabilities that cannot legally be
excluded.
To the maximum extent permitted by applicable law, MOKSH CIRCLE and NewEdge
Brands Private Limited will not be responsible for indirect, incidental, special or
consequential losses that are not a reasonably foreseeable direct result of our breach.
Where legally permitted, our monetary liability arising directly from a particular
purchase will ordinarily not exceed the amount actually paid for the relevant
product/order.
This limitation does not override mandatory rights relating to defective goods, deficient
services, unfair trade practices or other protections available under applicable Indian
law.
27. INDEMNIFICATION
To the extent permitted by law, customers may be responsible for reasonable
third-party claims or losses directly resulting from: Fraudulent activity, Illegal use of the
Website, Material breach of these Terms, Intellectual-property infringement or
Malicious interference with our systems.
Customers are not responsible for matters for which MOKSH CIRCLE is legally liable.
28. SUSPENSION & TERMINATION
We may suspend or terminate Website/account access where reasonably necessary
due to: Fraud, Security threats, Fake orders, COD abuse, Illegal activity,
Intellectual-property violations or Material breach of these Terms.
Existing transaction-related rights and obligations may continue where applicable.
29. CHANGES TO TERMS
We may update these Terms due to Business, Operational, Technical or Legal changes.
The latest version will be published on mokshcircle.com with an updated “Last
Updated” date.
Changes will not retrospectively remove rights relating to already accepted orders
where applicable law prevents this.
30. GOVERNING LAW & JURISDICTION
These Terms and transactions through MOKSH CIRCLE are governed by the laws of
India.
Subject to mandatory consumer rights and jurisdiction rules, competent courts at
Surat, Gujarat, India will have jurisdiction.
Nothing prevents customers from approaching a consumer commission, authority or
other forum available under applicable law.
